ORDINANCE NO. 18-17
AMENDMENT TO CHAPTER 106 OF THE MUNICIPAL CODE REGARDING UNIFORM BUILDING CODE
ADOPTION AND ENFORCEMENT
Ordinance amending Chapter 106 of the Municipal Code
Whereas, Municipal Code Chapter 106 regarding building construction within the City of Hudson is not in compliance or in need of updating,
Now therefore, the Common Council of the City of Hudson hereby ordains as follows:
The City of Hudson Municipal Code Section 106-35 Violations and Penalties is hereby repealed and recreated as follows:
§ 106-35 Violations and penalties.
Any person who shall violate any provision of this chapter or any rules, regulations or orders of the Building Inspector or his duly authorized deputies and representatives shall be subject to a penalty as provided in Chapter 1, § 1-18, of this Code outlined in 106-35.A through E.
A. If construction is started prior to issuance of a permit, the fee will be double for the first violation and triple for subsequent violations. A stop-work order may be served on the owner or his or her representative and a copy thereof shall be posted on the construction site for failure to obtain the necessary permit(s). Such stop-work order shall not be removed except by written notice of the Building Inspector.
B. The enforcement of this chapter and all other laws and ordinances relating to building shall be by means of the withholding of building permits, imposition of forfeitures and/or injunctive action. Forfeitures shall be not less than $25.00 nor more than $1,000.00 for each day of noncompliance.
C. If an inspection reveals a noncompliance with this chapter or the Uniform Dwelling Code, the Building Inspector shall notify the applicant and the owner, in writing, of the violation(s) to be corrected. All cited violations shall be corrected within 30 days after written notification, unless an extension of time is granted pursuant to the Wisconsin Administrative Code.
D.  If, after written notification, the violation is not corrected within 30 days, a stop-work order may be served on the owner or his representative, and a copy thereof shall be posted at the construction site. Such stop-work order shall not be removed except by written notice of the Building Inspector after satisfactory evidence has been supplied that the cited violation has been corrected.
E.  Each day such violation continues after the thirty-day written notice period has run shall constitute a separate offense. Nothing in this chapter shall preclude the City from maintaining any appropriate action to prevent or remove a violation of any provision of this chapter or the Uniform Dwelling Code.
The City of Hudson Municipal Code Section 106-8 Wisconsin Administrative Code adopted is hereby repealed and recreated as follows:
§ 106-8 Wisconsin Administrative Code adopted.
The following chapters or sections of the Wisconsin Administrative Code, and associated adopted International Codes, are hereby made by reference a part of this chapter as though fully set forth herein, except that where other provisions in the Municipal Code are different and more restrictive, the Municipal Code shall govern. A copy of the Wisconsin Administrative Code is on file in the office of the Building Inspector.

This ordinance shall take effect and be in force from and after its passage and publication as required by law.
