ORDINANCE No. 5-13
AN ORDINANCE ANNEXING TERRITORY TO
THE CITY OF HUDSON, WISCONSIN
THE COMMON COUNCIL OF THE CITY OF HUDSON DO ORDAIN AS FOLLOWS:
SECTION 1. Territory Annexed. In accordance with Section 66.031 of the Wisconsin Statutes and the petition for direct annexation filed with the City Clerk on August 9, 2013 signed by the land owner in the territory, the following described territory in the town of Hudson, St. Croix County, Wisconsin is annexed to the City of Hudson, Wisconsin:
A PARCEL OF LAND LOCATED IN PART OF THE NE 1/4 OF THE NE 1/4 AND IN PART OF THE SE 1/4 OF THE NE 1/4 OF SECTION 32, TOWNSHIP 29 NORTH, RANGE 19 WEST, FURTHER DESCRIBED AS FOLLOWS: COMMENCING AT THE N1/4 CORNER OF SAID SECTION 32; THENCE S89°19\'21" W, ALONG THE NORTH LINE OF THE NE 1/4, 1307.39 FEET TO THE WEST LINE OF THE NE1/4 OF THE NE1/4; THENCE S00°09\'01"E, ALONG SAID WEST LINE, 1,334.39 FEET TO THE SW CORNER OF SAID NE1/4 OF THE NE1/4, BEING THE POINT OF BEGINNING; THENCE S80°l0\'06"E, ALONG THE NORTH LINE OF OUTLOT 10 OF THE PLAT OF RED CEDAR CANYON FIRST ADDITION RECORDED AT THE ST. CROIX COUNTY REGISTER OF DEEDS OFFICE, 687.20 FEET TO THE WEST LINE OF SAID OUTLOT; THENCE N24°37\'54"E, ALONG SAID WEST LINE, 65.07 FEET TO THE PREVIOUS POSITION OF THE CENTERLINE OF STAGELINE ROAD AS POSITIONED FROM FOUND MONUMENTATION AS SHOWN ON CERTIFIED SURVEY MAP RECORDED IN VOLUME 2, PAGE 366 AT THE ST. CROIX COUNTY REGISTER OF DEEDS OFFICE; THENCE N55°56\'09"W, ALONG SAID PREVIOUS CENTERLINE, 851.42 FEET TO SAID WEST LINE OF THE NE1/4 OF THE NE1/4; THENCE S00°09\'01"E, ALONG SAID WEST LINE, 418.71 FEET TO THE POINT OF BEGINNING. PARCEL CONTAINS 3.88 ACRES (169,016 SQ. FT.) AND IS SUBJECT TO PUBLIC ROAD (STAGELINE ROAD) RIGHT-OF-WAY AND ALL OTHER EASEMENTS, RESTRICTIONS AND COVENANTS OF RECORD.
SECTION 2. Effect of Annexation. From and after the date of this ordinance the territory described in Section 1 shall be a part of the City of Hudson for any and all purposes provided by law and all persons coming or residing within such territory shall be subject to all ordinances, rules and regulations governing the City of Hudson, Wisconsin.
SECTION 3. Zoning Classification. The territory shall be designated as R-1, One-family Residential District, pursuant to Municipal Code, Chapter 255 Zoning, Section 255-12. The territory is designated as Medium Density Residential in the 2009 City of Hudson comprehensive plan. An application shall be submitted by the land owner to initiate a request to rezone the property to RM-1, Multiple Family Residential District.
SECTION 4. Ward Designation. The territory described in Section 1 of this ordinance is hereby made a part of the Third Ward of the City of Hudson.
SECTION 5. Severability. If any portion of this ordinance is invalid or unconstitutional, or if the application of this ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the other provisions or applications of this ordinance which can be given effect without the invalid or unconstitutional provision or application.
SECTION 6. Effective date. This ordinance shall take effect upon passage and publication as provided by law.
