NH man convicted in sex case, assessment ordered

A North Hudson man was convicted of misdemeanor crimes in a plea bargain agreement Friday afternoon with an unusual twist. Cody Allen Klatt, 24, pleaded no contest to sexual intercourse with a child and battery.

The plea agreement reached by District Attorney Eric Johnson and defense attorney James Bartholomew included probation for three years on the misdemeanor charges and a deferred judgment agreement for five years in a felony possession of child pornography charge.

However, Judge Eric J. Lundell wanted a scientific assessment of Klatt to determine "the likelihood of this happening again," and ordered a pre-sentence investigation (PSI) to include such testing.

A PSI is usually reserved for felony convictions and is ordered before a sentence is handed down.

Johnson said Klatt, "suffered from significant health issues while growing up," and wasn't considered a sexual predator. The diminutive Klatt, who reportedly weighs about 100-pounds, was engulfed by the chair he sat in at the defense table.

The original charges included felony counts of second-degree sex assault of a child, child enticement and possession of child pornography and misdemeanor sex with a child age 16 or older. He posted a $10,000 signature bond on Oct. 12.

The criminal complaint said Klatt had made sexual contact with a 15-year-old girl in January 2010. The complaint also alleged that Klatt had sex with a 16-year-old girl on April 2, 2012 in North Hudson, gave her rides in his truck and had topless photos she sent to his cell phone in his possession.

Police were contacted by the father of the 16-year-old girl who accused Klatt of sending sexual text messages to her. The complaint said the girl had been interacting with Cody on Facebook since Sept. 2011.
