New Richmond girl, 14, charged with attempted homicide

Steven Avery tries to convince judge today that he deserves a new trial in brutal murder

Steven Avery will try to convince a judge in Manitowoc today that he deserves a new trial in the brutal murder of Teresa Halbach.

Avery said Circuit Judge Patrick Willis made a big mistake in his original trial in which he was convicted and sentenced to life in prison.

Avery said the defense should have been allowed to show that others had the motive to kill Halbach, 25, at his family's auto salvage yard on Halloween of 2005.

The jury heard six weeks of testimony, and a member of that jury will also testify at today's hearing.

Avery and his nephew, Brendan Dassey, were both found guilty of raping, shooting and burning Halbach who was taking pictures of vehicles for Auto Trader magazine at the time.

Dassey is also seeking a new trial.

The case made national headlines because Avery was freed from prison two and a half years before the killing.

That was after he served 18 years for a rape that DNA evidence later showed that somebody else committed.
