VILLAGE OF NORTH HUDSON: RESOLUTION NO. 2008 - 05

FINAL RESOLUTION AUTHORIZING STREET IMPROVEMENTS AND LEVYING SPECIAL ASSESSMENTS AGAINST BENEFITTED PROPERTIES

Trustee Zappa introduced the following resolution and moved its adoption:

RESOLUTION NO. 2008 - 05

FINAL RESOLUTION AUTHORIZING STREET IMPROVEMENTS AND LEVYING SPECIAL ASSESSMENTS AGAINST BENEFITTED PROPERTIES ON STATION LANE N. (BEGINNING APPROXIMATELY 200 FEET NORTH OF THE INTERSECTION WITH SOMMERS LANDING ROAD N. THEN NORTHERLY TO STATION CIRCLE N.); STATION CIRCLE N. (FROM STATION LANE N. TO SOMMERS LANDING ROAD N.); SOMMERS LANDING ROAD N. (FROM STATION CIRCLE N. TO APPROXIMATELY 150 FEET WEST OF PINE VIEW N.), VILLAGE OF NORTH HUDSON, ST. CROIX COUNTY, WISCONSIN.

WHEREAS, the Village Board of the Village of North Hudson, Wisconsin, held public hearings at the Village Hall, on Tuesday July 3rd, 2007, at 7:15 p.m. and Tuesday May 6th, 2008, at 7:15 p.m. for the purpose of hearing all interested persons concerning the preliminary resolution, report of the Village Engineer, final assessments against benefitted properties, and heard all persons who desired to speak at the hearing for the following public improvements:

Street Improvements on Station Lane N., Station Circle N., Sommers Landing Road N. and said improvements include engineering and administrative expenses.

NOW, THEREFORE, BE IT RESOLVED by the Village Board of the Village of North Hudson, as follows:

1. That the report of the Village Engineer dated April 21st, 2008, pertaining to the public improvements, including plans and specifications therefore, is adopted and approved.

2. That the Village has advertised for bids and the Village Engineer has provided for the supervision of the improvements with the report hereby adopted.

3. That payment for the improvements be made by assessing the cost to the property benefited as indicated in the summary of proposed assessments, dated April 21st, 2008.

4. That assessments shown on pages 9 thru 12 of the report, representing an exercise of the police power, have been determined on a reasonable basis and are hereby confirmed.

5. That the assessments for all projects included in the report are hereby combined as a single assessment but any interested property owner may object to each assessment separately or all assessments jointly for any purpose.

6. That all of said assessments shall be due and payable by October 25, 2008. Any property owner(s) subject to such assessments may, within thirty (30) days after mailing a copy of this resolution, file with the Village Clerk a written election to pay such assessments of principal as determined below, the first of which shall be paid by January 31, 2009, with further installments paid by the same day of each succeeding year thereafter, together with interest on the entire unpaid balance at a rate one-and-one-half percent (1-1/2%) higher than the rate of interest payable by the Village on funds borrowed for this project, with all accrued interest on the entire unpaid balance payable annually with each installment. The maximum number of installments which may be elected shall be determined by the total amount of assessments on each property (whether one or more), provided that assessments on contiguous properties with common ownership and uniform election of method of installment payment, may, at the owner’s option, be aggregated to determine the maximum number years of installments which the owner(s) may elect, to-wit:

7. That, without limitation by enumeration, the Village Board expressly reserves the power to hereafter re-open, reconsider, and increase, decrease, or otherwise amend, cancel or confirm or modify any or all of said assessments pursuant to section 66.0703 of the Wisconsin Statutes.

8. That the Village Clerk shall publish this resolution as a Class I Notice in the assessment district and mail a copy of this resolution and a statement of the final assessment against the benefited property to every property owner whose name appears on the assessment roll, whose post office address is known, or can with reasonable diligence be ascertained.

This resolution was approved at a regular meeting of the Village Board held on May 6, 2008 by a vote of 5 ayes and 0 nays.

The motion for the adoption of the foregoing Resolution was duly seconded by Trustee Thomas and, upon vote being taken it passed. Whereupon, said Resolution was declared duly passed and adopted, and approved and signed by the President and attested by the Village Administrator/Clerk/Treasurer.
