VILLAGE OF NORTH HUDSON: RESOLUTION NO. 2008-08
RESOLUTION AUTHORIZING THE VILLAGE OF NORTH HUDSON TO EXCEED THE LEVY LIMIT SPECIFIED UNDER SECTION 66.0602, WISCONSIN STATUTES ON AN ONGOING BASIS FOR LIBRARY COSTS

RESOLUTION AUTHORIZING THE VILLAGE OF NORTH HUDSON TO EXCEED THE LEVY LIMIT SPECIFIED UNDER SECTION 66.0602, WISCONSIN STATUTES ON AN ONGOING BASIS FOR LIBRARY COSTS
WHEREAS, under Section 66.0602 of the Wisconsin Statutes, no political subdivision of the State of Wisconsin may increase its tax levy in any year by a percentage that exceeds its “valuation factor,” which the Statutes define as the greater of (i) 2%, or (ii) the percentage change in the political subdivision’s January 1 equalized value due to new construction less improvements removed between the previous year and the current year; and
WHEREAS, for the Village of North Hudson, St. Croix County, Wisconsin (the “Village”), the 2007 tax levy (collected in 2008) subject to Section 66.0602 of the Wisconsin Statutes was $1,218,672; and the valuation factor for the Village is 2.00% (or $24,373.44) so that the allowable levy for 2008 (collected in 2009) subject to Section 66.0602 of the Wisconsin Statutes will be $1,243,045.44; and
WHEREAS, the Village has established and participates in the Hudson Area Joint Library pursuant to a Joint Library Agreement, as amended, with the City of Hudson, the Town of Hudson, and the Town of St. Joseph; and
WHEREAS, the Village Board of the Village has determined that it is desirable and in the best interest of the Village to participate in the acquisition, renovation and equipping of a new Hudson Area Joint Library facility to be located at 700 First Street in Hudson, Wisconsin; and
WHEREAS, the Village Board of the Village has determined it is desirable and in the best interest of the Village to exceed the levy limit by an additional $85,379 on an ongoing basis (which, for the allowable 2008 levy collected in 2009, equals 7.00%), for the purpose of paying the Village’s portion of the costs associated with the ongoing operation of the proposed new Hudson Area Joint Library Facility to be located at 700 First Street in Hudson, Wisconsin; and
WHEREAS, Section 66.0602 of the Wisconsin Statutes, which imposes the above-described levy limit, is set to be repealed by operation of a sunset clause effective November 30, 2009; and
WHEREAS, the Village Board has determined it is desirable and in the best interest of the Village to seek authorization from the electorate to exceed the levy limit under Section 66.0602, or any successor thereto, on an ongoing basis in recognition that Section 66.0602 may be amended or renewed in the future.
NOW, THEREFORE, BE IT RESOLVED by the Village Board of the Village, that the Village be allowed to exceed the levy limit specified in Section 66.0602, Wisconsin Statutes, or any successor thereto, by $85,379 on an ongoing basis (which, for the allowable 2008 levy collected in 2009, equals 7.00%), for the purpose of paying the Village’s portion of the costs associated with the ongoing operation of the proposed new Hudson Area Joint Library facility to be located at 700 First Street in Hudson, Wisconsin.
