CITY OF HUDSON: ORDINANCE NO. 7-08

Re: Amend the Hudson City Code Chapter 59, Regarding Officers and Employees

In the interest of the public health, safety, and welfare, the Common Council finds it necessary and appropriate to amend the Hudson City Code Chapter 59 to be consistent with Wisconsin Statutes and the City of Hudson Employee Handbook, and, to that end, the Common Council hereby ordains that Hudson City Code Chapter 59, Regarding Officers and Employees, shall be amended to read as follows:

59-3. Appointed officials.

A. Enumerated. The following shall consist of the appointed officials of the City, and the method of appointment shall be as indicated: [Amended by Ord. No. 2-94; Charter Ord. No. 1-96EN]

B. Term of office. All such officers shall be appointed for indefinite terms.

C. Removal. All such officers appointed by the Common Council shall serve at the pleasure of the Common Council until their successors are appointed and qualify, unless the office is vacated by resignation or death or unless such officer shall be removed by the Common Council in accordance with applicable Wisconsin law.

§ 59-4. Salaries and compensation. [Amended 2-2-2004 by Ord. No. 2-04]

A. Salaries and compensation of appointed City officials and employees shall be determined by the Common Council from time to time.

B. Salaries for the Common Council members and the Mayor shall be determined in accordance with Wisconsin Statutes. The salary for Council members taking office in terms beginning on or after the spring 2004 election shall be $3,600 a year. The salary for the Mayor taking office in the terms beginning on or after the Spring 2004 election shall be $12,000 a year.

§ 59-5. Retirement.

A. Wisconsin Retirement Fund. The City elects to include eligible City personnel under the provisions of the Wisconsin Retirement Fund in accordance with W.S.A. §§ 40.01 and 40.02. See Charter Ordinance No. 75.EN

§ 59-6. Residency requirements for department heads. [Added by Ord. No. 5-84]

A. Purpose. The city desires to enhance certain employees’ community pride and efficiency of operation, to provide for an effective recall of employees during emergency situations and to promote understanding of local customs and habits through the development of a community identity resulting from residency in the Hudson School District.

B. The following department heads shall become residents of the Hudson School District as a condition of employment: [Amended by Ord. No. 14-92; 5-1-2000 by Ord. No. 9-00]

(1) Assessor-Building Inspector.

(2) Director of Public Works and Parks.

(3) Chief of Police.

(4) Community Development Director.

(5) City Clerk.

(6) Finance Officer.

(7) City Administrator

C. An employee appointed to any of the foregoing department head positions shall have one year to comply with the residency requirements contained herein. If it appears that an additional reasonable period of time is in order to acquire residence as required herein, the Common Council may consider and allow an extension of time in which to satisfy the residency requirements. The provisions of this section shall apply to department heads appointed subsequent to May 21, 1984. [Amended by Ord. No. 14-92]

§ 59-7. City Administrator. [Added by Ord. No. 33-95]

A. Appointment procedure. The City Administrator shall be appointed by a two-thirds vote of the entire Common Council. Selection and appointment of the City Administrator shall be based solely upon the principles of merit and fitness. The City Administrator shall serve at the pleasure of the Common Council or as provided by contract.

B. Powers and duties. The City Administrator shall have such powers and duties as may be delegated and conferred by the Common Council in the form of a job description which may, from time to time, be amended or changed by the Council.
