Notice of amended and recreated Chapter 253, Floodplain Zoning

Notice is hereby given that the City of Hudson Common Council enacted Ordinance No. 1–09, amending and recreating Municipal Chapter 253, Floodplain Zoning.

The ordinance amends and recreates the floodplain zoning code to bring it into compliance with the model floodplain zoning codes of the Wisconsin Department of Natural Resources (WisDNR) and to reference the new Federal Emergency Management Agency (FEMA) flood insurance rate maps (FIRMs). The ordinance contains the references to the flood insurance rate maps that become effective March 16, 2009, the regional flood elevation, and the regulations pertaining to development. The floodplain zoning code regulates building and site improvements in the floodway and floodfringe areas, as defined by the floodplain zoning code.

Specific amendments to Chapter 253, Floodplain Zoning are:

  • new flood insurance rate map references

  • establishes the North American Vertical Datum (NAVD), 1988 adjustment as the base datum for the regional flood elevation

  • provide for requirements for structures in a floodway and floodfringe areas

  • revise limitations of damage to or destruction of non-conforming uses

  • access to areas of buildings below the flood protection elevation

  • access to information on conducting substantial damage assessments

  • adds a definition of the North American Vertical Datum (NAVD) to mean the sea level datum, 1988 adjustment.
