ORDINANCE NO. 02-2012

AN ORDINANCE AMENDING THE MUNICIPAL CODE FOR THE VILLAGE OF NORTH HUDSON, WISCONSIN

WHEREAS, the Board of Trustees of the Village of North Hudson wishes to amend Chapter 2, Administration, Article I. In General, Section 2-1 Elected officials., and Chapter 26, Court, Section 26-1., Municipal judge., of the Village of North Hudson Municipal Code. (Deleted language is struck through, created language is underlined.)

NOW THEREFORE, the Board of Trustees of the Village of North Hudson does ordain as follows:

Sec. 2-1. Elected officials.

The elected officials of the village shall be as follows:

Sec. 26-1. Municipal judge.

(a) Office created. Pursuant to Wis. Stats. § 755.01, there is created the office of municipal judge.

(b) Election; term. The municipal judge shall be elected at large at the spring election in odd-numbered years for a term of four two years, or until a successor is elected and qualifies, commencing on May 1 next succeeding his election. Midterm vacancies in the office of municipal judge shall be filled by special election as provided in Wis. Stats. § 8.50.

(c) Salary. The municipal judge shall receive a salary as determined from time to time by the board, which shall be in lieu of fees and costs. No salary shall be paid to the judge for any time during his term for which he has not executed and filed his official bond and oath as required by subsection (d) of this section.

(d) Bond; oath. The municipal judge shall execute and file with the clerk of the circuit court for the county the oath prescribed by Wis. Stats. § 757.02, and a bond in the penal sum of $10,000.00. The municipal judge shall not be qualified to act until a certified copy of the bond is filed with the clerk and a certified copy of the oath is filed with the office of the director of state courts as required by Wis. Stats. § 755.03.

(e) Jurisdiction. The municipal judge shall have jurisdiction as provided by law and Wis. Stats. § 755.045 and exclusive jurisdiction of violations of village ordinances, resolutions and bylaws.
