ORDINANCE NO. 03-2012
AN ORDINANCE AMENDING THE MUNICIPAL CODE FOR THE VILLAGE OF NORTH HUDSON, WISCONSIN
WHEREAS, the Board of Trustees of the Village of North Hudson wishes to amend Chapter 70, Offenses and Miscellaneous Provisions, Article I. In General, Section 70-6 Loud and unnecessary noise prohibited., of the Village of North Hudson Municipal Code. (Deleted language is struck through, created language is underlined.)
NOW THEREFORE, the Board of Trustees of the Village of North Hudson does ordain as follows:
Sec. 70-6. - Loud and unnecessary noise prohibited.
(a) Noises prohibited. No person shall make or cause to be made assist in making any loud, disturbing or unnecessary sounds or noises such as may tending to unreasonably annoy or disturb another in or about any public street, alley, park or any private residence the peace and quiet of persons in the vicinity thereof unless the making and continuing of the same cannot be prevented and is necessary for the protection or preservation of property or the health, safety, life or limb of some person.
(b) Operation of motor vehicles. No person shall, within the village, on public or private property, by or through the use of a motor vehicle, motorcycle, snowmobile or minibike, under circumstances which tend to cause or provoke a disturbance or annoy one or more persons, engage in violent, abusive, unreasonably loud or otherwise disorderly conduct, including but not limited to unnecessary or deliberate or intentional: spinning of wheels; squealing of tires; revving of the engine; blowing the horn; causing the engine to backfire; or cause the vehicle, while commencing to move or in motion, to raise one or more of its wheels off the ground. Such conduct is declared to be both unlawful and a nuisance. The penalty for violation of this section shall be a penalty as provided in section 1-11.
(c) The provisions describing and defining regulations with respect to vehicles and traffic in subsection (b) of this section are adopted and incorporated by reference in section 90-1 as a part of traffic laws adopted in that section. Any act performed or prohibited by this chapter for purposes of traffic regulation and the imposition of penalty shall be identified and referenced as disorderly conduct with a motor vehicle.
(d) Construction, repairing of buildings, and landscape maintenance noise prohibited. It is unlawful for any person, company or business to operate equipment or perform any outside construction or repair work on buildings, structures or projects, or to operate any pile driver, power shovel, pneumatic hammer, derrick, power hoist or any other construction type device or vehicle in the village, during the "Quiet Hours" times specified in this subsection. This includes, but is not limited to, the erection (including excavating), demolition, alteration or repair of any building, structure, or project, any domestic tool noise, machinery noise, or loading/unloading noise. This subsection shall not apply to the performance of emergency work necessary to protect health, safety, and welfare of persons or property, or to restore utility service or other phone service or to authorized village public works employees engaged in village public works business.
Quiet Hours, Monday - Friday: 9:00 p.m. to 7:00 a.m.
Quiet Hours, Saturday, Sundays, and Holidays: 9:00 p.m. to
8:00 a.m.
The penalty for violation of this subsection shall be a penalty as provided in subsection 1-11(a)(5).
