VILLAGE OF NORTH HUDSON
ORDINANCE NO. 05-2012
AN ORDINANCE AMENDING THE MUNICIPAL CODE FOR THE VILLAGE OF NORTH HUDSON, WISCONSIN
WHEREAS, the Board of Trustees of the Village of North Hudson wishes to amend Chapter 2, Administration, Article V. Finance and Taxation., Division 1. Generally., Section 2-302. Direct legislation capital project., of the Village of North Hudson Municipal Code. (Deleted language is struck through, created language is underlined.)
NOW THEREFORE, the Board of Trustees of the Village of North Hudson does ordain as follows:
Sec. 2-302. Direct legislation capital project.
Prior to the start of any physical construction of any municipality financed (in whole or in part) project requiring a village capital expenditure of $150,000.00 $900,000 or more, and would result in an increase in real property taxes, the village board shall submit to the electorate a binding referendum for approval of the project. Failure of the binding referendum shall preclude the village from proceeding with the project. Capital expenditures for maintenance, repair or replacement of existing utilities or infrastructure, or pursuant to existing contractual obligations or legal mandates shall be exempt from this section. The wording of any referendum shall provide the specific purpose, location and cost of the project. Nothing in this provision shall be construed to preclude the village from exercising its role in the planning or design of such publicly financed projects.
