RESOLUTION NO. 8 -12

Resolution offered by Council member Morrissette and

seconded by Council member Yacoub.

RESOLUTION WAIVING BIDDING REQUIREMENTS OF WISCONSIN STATUTES, SECTION 66.1103(11)(b)(1), AS AMENDED

BE IT RESOLVED by the Common Council of the City of Hudson, Wisconsin (the “City”), as follows:

WHEREAS, the City has heretofore preliminary approved the issuance of industrial revenue bonds or a single note (the “Bonds”) in accordance with Section 66.1103, Wisconsin Statutes, as amended, and other Wisconsin Statutes (collectively, the “Statute”), to assist in financing the construction and equipping of an expansion of the existing facilities at 1700 Livingstone Road and 1401 Industrial Street (the “Project”) in Hudson owned or leased by United Gear and Assembly, Inc. (the “Company”); and

WHEREAS, the Company has requested that the bidding requirements of Wisconsin Statutes, Section 66.1103(11)(b) (1) be waived; and

WHEREAS, the city has determined that it would be in the best interest of the City to grant such a waiver in that such waiver would allow the Company the flexibility to solicit bids and evaluate each bid not only on the basis of cost but also to assure that the desired quality of workmanship of the Project will be maintained.

BE IT RESOLVED, pursuant to Wisconsin Statutes, Section 66.1103(11)(b)(2), the Wisconsin Statutes, Section 66.1103 (11)(b)(1) regarding bidding requirements, are hereby waived.

BE IT RESOLVED FURTHER, pursuant to and as required by Wisconsin Statutes, Section 66.1103(b)(2), the Clerk is hereby authorized and directed to publish this Resolution as a Class I notice under Wisconsin Statutes, Chapter 985.
