VILLAGE OF NORTH HUDSON

ORDINANCE NO. 10-2012

AN ORDINANCE AMENDING THE MUNICIPAL CODE FOR THE VILLAGE OF NORTH HUDSON, WISCONSIN

WHEREAS, the Board of Trustees of the Village of North Hudson wishes to amend Chapter 10, Animals, Article I. In General, Section 10-13. Control, of the Village of North Hudson Municipal Code. (Deleted language is struck through, created language is underlined.)

NOW THEREFORE, the Board of Trustees of the Village of North Hudson does ordain as follows:

Sec. 10-13. – Control

(a) No person owning, possessing or harboring any animal shall allow it to run at large within the village. The owner shall keep his animal under control at all times and shall not permit such animal to be at large, off the premises or property of the owner, unless under the control of a competent person.

(b) No more than three (3) dogs may be harbored or kept in any one household, except as follows:

(1) A single litter of pups, or a portion of that litter, may be kept for a period of time not exceeding five (5) months from birth.

(2) A person harboring or keeping more than three (3) dogs in one household within the Village on December 1, 2012, or a person moving into the Village after that date with more than three (3) dogs, shall be permitted to harbor or keep in their possession those specific dogs under the following conditions:

(A) Required license fees for each dog have been paid, the licenses are continually maintained in full force and effect, and proof thereof is furnished to the village;

(B) Required and effective rabies immunization for each dog has been procured, and continually maintained, and proof thereof is furnished to the village;

(C) An exemption for harboring more than three (3) dogs is temporary and applies to those specific dogs only, and shall not authorize the replacement of any specific dog which would result in continuing an excess of three (3) dogs. The burden of proving entitlement to this exemption is upon the party seeking the exemption. This temporary exemption shall be strictly construed to effectuate the goal of a maximum of three (3) dogs per household within the Village.

(c) Kennel permits and their specifications shall be issued by the board upon receipt of applications and recommendations from the animal warden. No kennel shall be built, maintained or used unless constructed in accordance with such permit and its specifications.

Adopted by the Village Board this 8th day of November, 2012.
