MINUTES Regular Council Meeting 7:00 PM - Monday, November 1, 2021 Council Chambers The City of Hudson Council met in Regular Council on Monday, November 1, 2021, at 7:00 PM in the Council Chambers. The Common Council meeting was called to order by Mayor Rich O'Connor at 7:01pm and led those in the Pledge of Allegiance. Council Present:Mayor Rich O'Connor, Alderperson -Dist 1 Randy Morrissette II, Alderperson - Dist 2 Bill Alms, Alderperson - Dist 3 Paul Deziel, Alderperson - Dist 4 Jim Webber, Alderperson - Dist 5 Sarah Bruch, and Alderperson - Dist 6 Joyce Hall Council Absent: Staff Present:City Attorney - Nick Vivian, City Administrator - Aaron Reeves, Finance Director - Alison Egger, Clerk - Becky Eggen, Techonolgy Director - Bryan Watson, City Engineer - Dean Chamberlain, Police Chief - Geoff Willems, Assistant City Administrator/Community Development Director - Michael Johnson, and Public Works Director - Mike Mroz A.Presentation on 2020 Financial Report April Anderson, CPA from Clifton Allen Larson gave a review of the 2020 financial report. A.Public hearing on Applications received for the available Reserve Class "B" Beer and Class "B" Liquor license. "The Three Tradesman applicant(s) spoke in favor of their application and plans. Motion by Alderperson - Dist 6: Joyce Hall, second by Alderperson - Dist 3: Paul Deziel to close the public hearing Carried unanimously. B.Discussion and possible action on granting the available Reserve Class "B" Beer/Class "B" Liquor application Motion by Alderperson - Dist 6: Joyce Hall, second by Alderperson - Dist 5: Sarah Bruch to issue the Class "B" Liquor and Class "B" Beer liquor license to Key's Café. Motion by Alderperson -Dist 1: Randy Morrissette II, second by Alderperson - Dist 2: Bill Alms to postpone acting for one month for the Three Tradesman applicant to come back with a solid plan. Carried 4-2 (opposed: Alderperson - Dist 5: Sarah Bruch and Alderperson - Dist 6: Joyce Hall). C.Public hearing regarding adoption of special assessments for 2020 Sidewalk Replacement Project for 517 2nd Street property Motion by Alderperson - Dist 2: Bill Alms, second by Alderperson - Dist 6: Joyce Hall to close the public hearing. Carried unanimously. D.Discussion and possible action regarding adoption of Resolution 23-21; adoption of special assessments for the 2020 Sidewalk Replacement Project for 517 2nd Street property Motion by Alderperson - Dist 3: Paul Deziel, second by Alderperson - Dist 6: Joyce Hall to suspend the rules. Roll call vote. Carried unanimously. Motion by Alderperson - Dist 3: Paul Deziel, second by Alderperson - Dist 6: Joyce Hall to adopt Resolution 23-21, adopting special assessments for the 2020 Sidewalk Replacement Project for 517 2nd Street property. Carried unanimously. A.Approve Claims in the amount of $989,353.23 B.Approve the meeting minutes from the October 18, 2021, Regular Council Meeting C.Approve the request by St Croix Sailing School to extend the lease of space at 18 Buckeye Street beginning November 1, 2021, through April 1, 2022 Motion by Alderperson - Dist 3: Paul Deziel, second by Alderperson - Dist 6: Joyce Hall to approve the consent agenda. Roll call vote. Carried unanimously. A.Interview Candidates who applied for the upcoming vacancy of District 4 Council Seat followed by discussion and possible action "Sammi Dittloff, one of the candidates, introduced herself and shared her interests of filling the vacant seat. Motion by Alderperson - Dist 6: Joyce Hall, second by Alderperson - Dist 5: Sarah Bruch to appoint candidate Sammi Dittloff to the upcoming District 4 vacant seat. Failed 3-2 (opposed: Alderperson -Dist 1: Randy Morrissette II and Alderperson - Dist 2: Bill Alms). Appoint candidate Jeanne Joseph - No one in favor. Opposed 6-0 Motion by Alderperson - Dist 6: Joyce Hall, second by Alderperson - Dist 4: Jim Webber Mayor offered another ballot for candidante Sammi Dittlof. 3-2 (opposed: Alderperson -Dist 1: Randy Morrissette II and Alderperson - Dist 2: Bill Alms). Mayor moved forward with the agenda; the seat stays vacant. Next agenda will have a timeline and costs of a special election to discuss further. B.Discussion and possible action to approve Resolution 24-21, Adopting Final Ward Boundaries Motion by Alderperson -Dist 1: Randy Morrissette II, second by Alderperson - Dist 6: Joyce Hall to suspend the rules. Roll call vote. Carried unanimously. Motion by Alderperson -Dist 1: Randy Morrissette II, second by Alderperson - Dist 3: Paul Deziel to approve Resolution 24-21; Adopting the final Ward Boundaries Carried unanimously. A.Update from Mayor on Library Funding "Mayor and Public Works Director, Mike Mroz, gave a storm damage update of clean up on the cleanup of the library. Mayor also gave and update on Library Funding. 8CLOSED SESSION Notice is hereby given that the City Council may proceed into a closed session, upon possible motion to enter closed session. A.Closed Session pursuant to Wis. Stat. §19.85(1)(g) to confer with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved. B.Closed Session purusant to Wis. Stat. §19.35(1)(g) for the purpose of conferring with legal counsel for the City to discuss strategy regarding pending litigation. Wal-Brand, LLC c/o Wal-Mart Real Estate Business Trust v. the City of Hudson - Property Tax Appeal. Motion by Alderperson - Dist 3: Paul Deziel, second by Alderperson - Dist 2: Bill Alms to go into closed session at 8:51pm. Carried unanimously. Motion by Alderperson - Dist 3: Paul Deziel, second by Alderperson - Dist 2: Bill Alms to reconvene into open session at 9:17pm. Carried unanimously. 9OPEN SESSION Reconvene in open session to take action that Council deems appropriate based on the Closed Session discussion or to move forward with the balance of the agenda. A.Discussion and possible action on possible litigation No action was taken on possible lititgation B.Discussion and possible action on Wal-Brand, LLC c/o Wal-Mart Real Estate Business v. the City of Hudson - Property Tax Appeal Motion by Alderperson - Dist 5: Sarah Bruch, second by Alderperson - Dist 6: Joyce Hall to approve a claim adjusting the Wal-Brand evaluation to $5,764,200. Carried unanimously. 10COMMUNICATIONS AND RECOMMENDATIONS OF THE MAYOR "Mayor congratulated the Hudson women's tennis team for making the State tournament "Morrissette would like to have the streetlights downtown looked at as they have not been working "Bruch asked the mayor to give insight of who would be filling the vacant seats on various committees 11 ADJOURNMENT Motion by Alderperson -Dist 1: Randy Morrissette II, second by Alderperson - Dist 3: Paul Deziel to adjourn at 9:21pm.
